1. Acceptance of Terms

By accessing or using the GoLocal Max platform (“GoLocal Max,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy.

If you do not agree to these Terms, do not use the platform.

These Terms form a legally binding agreement between you (“User,” “you,” or “your”) and GoLocal Max LLC.

2. Services Provided

GoLocal Max provides cloud-based marketing tools and software services, including but not limited to:

  • Local SEO and business citation management

  • Review and reputation management

  • AI-powered social media management and scheduling

  • Email marketing and campaign tools

  • AI chat and voice communication tools

  • CRM and client management

  • Advertising performance tracking and reporting

GoLocal Max continually develops and updates its services, and features may change or be added without prior notice.

3. Account Registration and Responsibility

To use GoLocal Max, you must create an account. You agree to:

  • Provide accurate and complete information during registration.

  • Keep your login credentials secure.

  • Accept full responsibility for all activity under your account.

If you suspect unauthorized access, you must notify us immediately at contact@golocalmax.com.

4. Subscription and Billing

  • GoLocal Max operates on a monthly subscription basis.

  • You authorize us to charge your chosen payment method automatically each month.

  • All sales are final. GoLocal Max does not offer refunds under any circumstances.

  • You may cancel your subscription by providing written notice or calling our support line at least 30 days before your next billing date.

  • Failure to cancel on time will result in your subscription automatically renewing for the next term.

5. Data Collection and Use

GoLocal Max collects and processes data from users and, in some cases, from their customers, including:

  • Business contact information

  • Customer names, emails, and feedback

  • Campaign and analytics data

We use this data solely to deliver, maintain, and improve our services.
We do not sell, rent, or share your data with third parties for marketing purposes.

6. User Content and Ownership

Users may upload or create content (e.g., reviews, emails, posts, messages) using GoLocal Max tools.
You retain ownership of your content, but you grant GoLocal Max a non-exclusive, worldwide, royalty-free license to store, display, and process that content solely for the purpose of operating and improving the platform.

You are responsible for ensuring that all uploaded or generated content:

  • Complies with applicable laws and third-party rights

  • Does not include illegal, defamatory, or harmful material

GoLocal Max reserves the right to remove any content that violates these terms or applicable laws.

7. AI-Generated Content Disclaimer

GoLocal Max includes artificial intelligence (“AI”) features that assist with creating marketing content, chat responses, and automations.
You understand and agree that:

  • AI-generated outputs may not always be accurate, complete, or compliant with advertising laws.

  • You are responsible for reviewing, editing, and approving all AI-generated content before publishing or use.

  • GoLocal Max assumes no liability for damages or losses arising from reliance on AI-generated material.

8. Intellectual Property

All software, trademarks, logos, branding, and documentation provided by GoLocal Max are the intellectual property of GoLocal Max LLC.

You may not copy, distribute, modify, reverse-engineer, or resell any part of the platform without express written consent.

9. Acceptable Use Policy

You agree not to use GoLocal Max to:

  • Send spam, unsolicited messages, or misleading communications.

  • Upload viruses or malicious code.

  • Engage in unlawful or deceptive marketing practices.

  • Interfere with other users or attempt to breach system security.

Violation of this section may result in immediate account suspension or termination.

10. Termination

We reserve the right to suspend or terminate your account without notice if you:

  • Violate these Terms

  • Engage in fraudulent, abusive, or harmful activity

  • Fail to make timely payments

Termination does not relieve you of payment obligations or restrict GoLocal Max’s right to recover outstanding balances.

11. Limitation of Liability

To the fullest extent permitted by law:

  • GoLocal Max LLC, its owners, employees, and affiliates shall not be liable for any indirect, incidental, or consequential damages, including lost profits, data loss, or service interruptions.

  • Our total liability for any claim related to the service shall not exceed the total amount you paid to GoLocal Max in the previous three (3) months.

All services are provided “as is” and without warranties of any kind, express or implied.

12. Indemnification

You agree to indemnify and hold harmless GoLocal Max LLC, its owners, and affiliates from any claims, damages, or expenses arising from your:

  • Use or misuse of the platform

  • Violation of these Terms

  • Infringement of any third-party rights

13. Dispute Resolution and Arbitration

All disputes arising under these Terms shall be resolved through binding arbitration in Fairfield County, Ohio, USA, in accordance with the rules of the American Arbitration Association (AAA).

You waive any right to participate in a class action lawsuit or class-wide arbitration.

The arbitrator’s decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, USA, without regard to conflict of law principles.

15. Changes to Terms

GoLocal Max may modify these Terms at any time. Updated Terms will be posted on our website with a revised “Last Updated” date. Continued use of the platform after changes take effect constitutes acceptance of the new Terms.
